I'm going to explain to you exactly what it means when your visa is refused.
If you don't know me, my name is Josh Goldstein and I'm an immigration lawyer in the United
States and I help people across the country and around the world reach their immigration
goals.
People just like you.
In today's video, I'm going to talk to you about the word refused and what it means in
the context of a visa application.
A lot of times people will see the word refused and they break into a panic because they think
that it means that their immigration case has been denied.
I want to assure you that your immigration case has not been denied if you see the word
refused.
I know this is confusing because the word refused is commonly thought of to be synonymous
with denied.
If I call up and order a pizza and I say I like a pizza with double cheese and pepperoni
and the guy on the phone says, I refuse, well, I'm not going to get the pizza.
But in this context, refused does not mean denied.
If refused doesn't mean denied, what does it mean?
What's going on?
Okay, I'll break it down for you very simply.
In March of 2020, right around the time of the pandemic, the State Department made an
announcement on its website.
All cases that were in administrative processing would therefore now be labeled as refused.
No change in the case status happened.
They just changed the words that they used.
Refused means administrative processing.
So if you look on CEAC, C-E-A-C, the case status tool for visas, and you see refused,
you have to read the notice very carefully to understand what's going on.
Let me do that with you now.
It says here, if you were informed by a consular officer that your case was refused for administrative
processing, your case will remain refused while undergoing such processing.
You will receive another adjudication once such processing is complete.
It's clear that no final decision has been made.
It's also clear that your case is undergoing some type of further review.
So if your case is refused, that means it's in administrative processing.
What that means is several things.
First, it means that you completed your visa interview.
Second, it means that no final decision was made.
Your case wasn't approved, and it wasn't denied.
And third, and most importantly, it means the adjudication process, the decision-making
process for your visa is ongoing.
So just because your case was refused doesn't mean you're going to get denied.
Just because it was refused doesn't mean any kind of decision at all was made.
And I want you to stay confident and know that you can reach your immigration goals.
And the most important thing of all, if you want to get out of administrative processing
or get out of refused status, you definitely have to watch this next video right here.
