The High Cost of Liability Claims - Is $1M Enough?
Sep 27, 2024
How's it going everybody?
Today we are going to be talking about professional liability insurance and what exactly that
policy typically covers.
Thank you for stopping by.
My name is Brian Gutowski.
I'm an independent insurance agent based here in the state of Michigan, Metro Detroit specifically,
and I work with businesses on their commercial insurance programs as well as helping families
and individuals with their personal insurance, their home, their auto insurance as well.
My goal with this channel is to pass on a little bit of educational information to you
so that you can make more informed decisions around your insurance, whether that's for
yourself, your business, or your family, and overall help answer any questions that you
might have.
So let's get into it.
Professional liability insurance, oftentimes referred to as errors and omissions insurance,
is designed to protect your business if a client claims that you've made a mistake in
the services that you have provided that has then caused them a financial loss.
This type of insurance is essential for any type of professional, such as consultants,
attorneys, accountants, architects, engineers, anyone that would provide any sort of advice,
IT consultants, IT specialists, real estate agents, and can even be necessary for certain
industries like construction or manufacturing.
So what does this policy actually cover?
At its core, professional liability insurance covers the cost associated with defending
your business against claims of negligence, misrepresentation, or mistakes.
This would include the legal fees, settlements, and any potential judgments that might come
from any of the claims.
For example, if you are a consultant and a client alleges that the advice that you gave
them caused them financial loss, a professional liability insurance policy would cover your
legal defense costs and any potential settlements.
A couple other real-life scenarios, first imagine an architect designing a building,
but there's an oversight that leads to structural issues.
The client then sues that architect for the cost of delays and repairs.
In this case, a professional liability policy would step in to cover the legal fees, defense
costs, and then any damages awarded.
Now let's imagine a construction company overseeing a project.
If there's a claim that improper oversight leads to defects or delays, a client might
sue them for the potential costs.
Here a professional liability policy would again step up to cover the legal fees and
any potential settlement.
Now in the case of someone like an IT consultant that was hired on to help install a new software
system, but there are bugs in the software that then causes the client's system to completely
go down and operations come to a standstill.
The client could then potentially sue the IT consultant for their losses incurred during
that downtime.
And in this case, professional liability insurance would again help cover legal defense costs
and any damages awarded.
There are many other scenarios and examples out there of professionals that have greatly
benefited from having these types of policies in place.
Again, a wide range, ranging from accountants to a real estate agent, whoever it may be,
that does provide that professional service, that professional advice that could financially
impact a client.
Because mistakes do happen, and having this professional liability insurance policy in
place is a great way to protect yourself and your business from potential unforeseen circumstances
that impact clients.
Another important thing to note is that each policy can be tailored to your business and
specific operations.
So it is important to work with an agent that does understand your business's needs to make
sure that you have the right policy coverages in place so that if a claim does ever happen,
you do have the right coverage.
