COPYRIGHT CLAIMS ARE SHUTTING DOWN THIS CHANNEL | Adrian Van Anz & David Deal Vs. Michael McCrudden

hey everyone uh Michael mcen here and first off I want to say a massive thank you to those of you who have supported me over the years now the journey certainly had its ups and downs and unfortunately I'm currently facing one of the biggest challenges yet guys I have an important announcement about this channel there is someone trying to take this channel famous entertainment down and have everything that I've worked so hard on deleted click the link in the top comments and I'll explain everything at the end of this video so please stay tuned and now with involved in a legal dispute with LA based photographer Adrien van ANS and his attorney David Deal they filed multiple copyright strikes against my wife's Channel famous entertainment now that's a channel many of you know and love and uh well YouTube only requires three strikes to terminate a channel and they went ahead and they filed four to resolve this they're demanding a large sum of money in amount that frankly I just don't have now we're not like some only fans couple we're not a high earning media Empire and uh when we were making money we invested heavily into our staff and our studio expecting to grow post pandemic but we uh we ran out of funds before the world like fully reopened and then with Canada's economy and a downturn well we've been working hard just to you know keep things a flow now I've been doing this for well over a decade now I mean I'm starting to show wear and tear the content we make in my opinion is transformative under the Digital Millennium Copyright Act now my video is not a market substitute for the original IM Imes used my videos do not directly compete with or replace the original work we use commentary for entertaining purposes criticism and comment all which fall under fair use and fair dealings here in Canada now in one example we're talking about an image that appears for 3 seconds in a video that's over 8 minutes in length now they could have asked to have the videos taken down via an email or to have the 3 seconds trimmed out of the video now we've both could have had like downloaded the video and then had it like reviewed in court this would have been a non-malicious approach now instead well they levied numerous strikes causing this financial harm and aggressively demanded an absurd amount of compensation with only like 48 hours to decide if if I could come up with the money or not I'm telling you this is an absurd amount and they're threatening me we're going to take things to the next level if you don't pay us I mean why do I need to have my channel which is our Revenue Source taken away and then be bullied to pay an obs seen amount of money now if they really feel that they're in the right instead of in my opinion making these threats towards me and my wife like just take us to court let's be civil let's have a judge make the correct decision in my opinion I feel like we don't have to be malicious and make threats also shut down my YouTube channel and uh you know there's two sides who have different views here on fair use laws so I guess the courts need to decide now the video in question it only made like a few hundred but the demand and well it's in the tens of thousands it's crazy now the lawyer David Deal in my opinion well he's got a personal Vendetta against me and other content creators after admitting via an email to having once been a commercial photographer himself and he has no sympathy for me at all clearly now also in my opinion he had emailed me not only with threats but also insulting my character at random times we're talking like 700 p.m. on a Sunday now my lawyer they asked if they even own the image and where they host their licensing fees and they refused to give us that information they just demanded us to pay tens of thousands of dollars without even working with us and giving us the proper information now we did an intense reverse image search of these images and we found hundreds of sites using these images all with multiple different names linked to it now it was impossible to find Adrien van an's website where he licenses out his content huh must be something he does regularly I guess I don't know no other YouTubers like h3h three they've taken these disputes to court and they've won Under fair use and fair dealings as it's referred to here in Canada now it is my belief that corporations and individuals are weaponizing copyright law to profit from and or shut down independent creators now fair use it exists for a reason but many use legal loopholes to suppress content instead of engaging in Fair competition right now we need your support we've launched the backup channel it's famous entertainment with Cara my wife is basically going to be doing the same thing but she's got to now start from scratch this is to ensure that we keep bringing you celebrity real estate content no matter what happens we're going to be posting there she's going to be posting dogs DIY projects a lot more now we've also created a GoFundMe page to help cover our legal expenses now I'm currently in talks with my legal team because we want to be 100% transparent and we want to post every single Email exchange I want to make sure that we're allowed to do that so I'll be telling you guys how to find my GoFundMe account sometime next week and uh well you and find out all the shocking details of this case now every contribution it helps us fight for Creator rights and protects the platforms we built together I refuse to let legal battles and corporate pressure erase what I've worked so hard to create I've stayed silent about these challenges for far too long I've hoped that things would resolve themselves like behind the scenes but this time I got to take a stand you
