Mr. Speaker, I request a ruling of the chair of whether or not House Bill 566 is an appropriations bill over which the governor has the authority to exercise a line item veto.
General McCracken, to your point of order, Kentucky Constitution Section 88 gives the governor power to disapprove any parts of an appropriation bill embracing distinct items.
House Bill 566 is not an appropriation bill. An appropriation bill primarily makes appropriations of money from the Treasury rather than enacting general laws, including incidental appropriations.
Pursuant to the Constitution and the opinions of two attorney generals, including one of each party, the attempt to veto portions of House Bill 566 has no effect.
The bill will therefore become law, unaltered by the purported veto, and shall be delivered to the Secretary of State and codified in that manner, unless House may choose to override the veto in order to prevent litigation.
General McCracken.
Mr. Speaker, I appreciate your point of order, so out of an abundance of caution, I would move you, sir, the final passage of House Bill 566, the veto or purported vetoes of the governor notwithstanding.
