It is not uncommon for an insurance carrier to delay payments to a disability insurance claimant. Nationwide Disability Insurance Attorneys Gregory Dell & Rachel Alters discuss what options a claimant may have when their disability insurance company has delayed their payments.
We have a lot of scenarios where someone's applied
for benefits or maybe they've been on claim
for a little bit and they call up and they say,
look, I've sent them everything that they've asked for
or I think I've sent them everything
that they're entitled to and they still don't wanna pay
or they're always two or three weeks late.
So what can we do as their legal representation
to help put an end or even soften this delay tactic
that we see on a regular basis
from people that are calling us?
I get this question a lot, Greg.
I get calls on a daily basis from claimants who say,
I've submitted my applications
and they've been taking months to make a decision.
Why are they doing this?
I said, because they can.
When you get a lawyer involved, they tend to,
we hold their feet to the fire.
We make them accountable.
We tend to put everything in writing
so that they know that they can't,
everything in writing goes into the claim file
and that becomes part of the administrative record
on the group claim.
So they know when an attorney's involved,
they can't screw around with these dates
and the payments as much as they do
when there's no attorney involved.
I know there's state laws and federal laws
about what the timeframe is for them even to respond.
Do they have seven days?
Do they have 14 days to respond to a letter?
Some carriers have internal guidelines
that we've seen through doing depositions
of all the employees from these companies.
And then we have things where it's considered bad faith,
claims handling to not respond to a letter
within say 21 days.
So that's why many claimants will get a letter
that just comes and looks like a form letter
after like 14 or 21 days.
They say, we received your letter
and we're still working on it.
Well, that's a garbage response.
It's not substantive, it doesn't go to the issue
and it's unreasonable delay.
So delay is a very serious problem,
especially in the world of disability benefits
where a person's waiting for that
to basically replace their paycheck every month.
I mean, they really need that money.
So when a disability company delays,
it's not only scary because you think
you're getting cut off,
but it also has a major financial impact
on a family's livelihood.
So we've seen all of these scenarios
and the different reasons for them to delay.
And often when we get a call,
I feel like we can cut right through the clutter
and help get to the point
of what that disability company's looking for.
