Hello friends, today I have another topic of international law with you.
The name of the topic is monistic theory.
Monistic theory is a theory that tells us what is the relationship between international law and municipal law.
Let's start. Before starting, I will tell you that you will get all the links of this chapter in the description.
This theory is also called monism theory.
Monistic theory was propounded by Mozart and Mortens.
According to this theory, state municipal law and international law are both parts of such universal legal system which fulfills the needs of humanity.
They are two species of law.
These two laws have different forms, different types and different generations.
The main purpose of international law and state municipal law is to fulfill the needs of humanity.
According to this theory, law is made for individuals.
The difference is that state municipal law is binding directly on the individuals while international law is binding through states.
In simple words, state municipal law is binding on the individuals while international law is binding on the states.
But these days, state municipal law is also binding on the international institutions.
State law and international law are two parts of law which are applicable to whole human community in one way or the other.
Conclusively, it can be said that root of all laws is individual as all laws are made for individuals.
According to O. Cornell, the objective of all the laws is human welfare whether it is municipal or international law.
