Hi, this is Melissa from Resilience Law, and I'm coming to you live from home today.
And I had a quick thought, I guess, on how Social Security handles veterans and how they treat them.
If you're applying for Social Security disability as a veteran, you probably have already explored
the option to get a VA disability rating. And so Social Security will look at whether or not
you have your VA disability rating. However, they make their own decision and it's based off
different rules than the VA system. So even if you do have a VA disability rating where you're
found fully disabled, that does not necessarily mean that you're automatically entitled to Social
Security disability. However, what it does give you is it gives you expedited processing.
So when you file your initial claim, it'll be processed more quickly than a typical claim.
And kind of as you go up through the levels, you're always going to be entitled to a
faster processing, particularly at the appeals council level, instead of waiting a year plus,
it can be a matter of weeks to get a decision. So it is important that you just bear in mind
that a VA disability rating is very different than Social Security. Although you can submit
the evidence and certainly the supporting decisions and any notes that you have from
your doctor for the VA disability rating can be extremely helpful in a Social Security disability
case. The two are not necessarily comparable. They may wind up being a totally different ruling.
You may be a hundred percent VA disabled and found not eligible for Social Security. I've
seen that quite a few times, particularly for younger veterans. So if you are a veteran looking
to apply for Social Security disability, that's something to keep in mind. It's definitely worth
your while to get a Social Security attorney to help you out. If you're interested,
my name is Melissa at Resilience Law. Give me a call. Let's get started.
