24-year-old Jocelyn Penalosa was taken into ICE custody after
a traffic stop by a Harris County Sheriff's deputy back in August.
According to her attorney,
she was partially in an intersection near Highway 6 and Westheimer.
Her sister says after Penalosa was stopped,
she had to wait over an hour for ICE agents to arrive.
I just want to tell her story because
I know that she didn't deserve it.
She was just coming from work. She's not like a criminal.
she's never even had a traffic ticket you know
the reason why she was driving
is because we need to work you know
to survive in this country sorry she's a
very smart person and I know
if she would have gotten the opportunity to
like study and go to college it would have
been better for her but because
she's undocumented
and she wasn't able to but she was the top 10 of her class a
a very smart person, and she cares for the people she knows,
even the people she doesn't know.
In a statement about the original traffic stop,
the Harris County Sheriff's Office says,
The Harris County Sheriff's Office is reviewing
the circumstances surrounding a traffic stop that
occurred on August 19, 2026,
to determine whether the deputy complied with all policies. The deputy
has been temporarily assigned
to non-traffic enforcement duties pending the outcome of the
internal review. The attorney representing
Penalosa's family says Jocelyn was first
booked into the Montgomery Processing Center in early August,
but was shortly transferred over
to the Otay Mesa Detention Center in California.
Tuesday, attorney Kim Bruno and her team were
able to secure an immigration bond for her.
She still has the charges that immigration gave her,
but it's getting her out of detention
because we go through the qualifying requirements,
which is she is not a flight risk.
She is not a danger to the community. She is not a threat to
national security. And for those reasons,
we were able to plead to the judge to let her out on a
bond so that she could proceed all immigration relief outside
of detention. I am still waiting
to hear back from the Department of Homeland Security,
but we'll keep you updated right here
on Fox Local. Angie Rodriguez, Fox 26 News.
