Governor Gavin Newsom celebrated a Supreme Court victory after the court rejected Donald Trump's emergency request to set aside 20,000 midterm ballots in California. While the DOJ has charged a small number of non-citizens for illegal voting, critics argue there is insufficient proof to justify sweeping changes to the voting system.
California Governor Gavin Newsom declaring
victory over President Trump after the Supreme
Court struck down his efforts
to set aside 20,000 midterm ballots in California.
The Justice Department has claimed that the ballots
in question are from likely non-citizens
and that California has not taken appropriate measures
to prevent non-citizens from voting
in this year's elections.
The Supreme Court's order was only one sentence long and did not
provide an explanation, simply writing that the injunction was denied.
Governor Newsom wrote on X, quote,
California just secured a historic Supreme Court defeat
against Donald Trump.
The court rejected Trump's emergency request without even asking
the other side to respond.
A first, democracy won, vote.
This comes as the DOJ announced charges
on Monday against six green card holders in California
accused of voting illegally.
That's in addition to the 28 others in the state who were also charged
with the same crimes last month.
The DOJ says the six individuals in question are from Mexico,
Canada, Iran, Israel, and the Philippines.
As the DOJ should, because it's illegal to not be
a citizen and vote in our elections.
The president, the problem is that he has failed to provide
adequate proof that this is worth trying to
Create major change days before an election.
And no, they they're welcome to do their jobs.
The federal law says that people
who are not American citizens cannot vote in elections.
And so 28 people out of the millions of people that cast
ballots every year for every or each year we have an election.
get caught as they should, they should get
the proper punishment. The president does not need
to upend our entire political
and voting system based on a lie from 2020 that he lost because it
was rigged and continue that narrative all the way up to 2026
because he wants to undermine
our election. There's a distinct difference
in what the strategy the president is implementing
versus the proof that he has that it needs to be this dramatic.
Sure, fine. The Supreme Court said you'd have to make the case.
Yeah, they can't.
Take your word for it. The 20,000 voters are not licensed to vote.
They're not legal voters.
And so they were not going to operate on that.
Again, the idea that the Supreme Court is some that some liberals have
that the Supreme Court is a rubber stamp of the Trump administration
is, again, a false notion because they rule against him constantly
on election stuff, on tariffs, on immigration issues again and again.
Do you know
how many
people
are voting in
California?
You're talking about 28 people?
Do you know how many millions of people are voting in California
and you want to be serious about?
The Trump administration is allowed to pursue and prosecute
anybody who's breaking the law,
but 28 compared to millions
goes back to all the Brennan Center studies
and every study that I've referenced
about the small, very minute percent of people
that are committing election fraud
and how it hasn't swayed any specific election.
Okay, well, they say it's 20,000. That's a little bit more.
No, they say it's 20,000, but they haven't provided adequate...
Proof. So the Supreme Court and the lower courts all shut it down.
This is not the first time the
president has tried to push this forward.
The lower courts said no. So that's why it went to
a higher court. And this is what I'm saying.
There's no proof of the 20,000 people.
The real issue, by the way,
is actually not that non-citizens are voting.
It's that non-citizens are inflating the.
Uh, the population levels of blue states.
And so maybe they're not voting with the presence of
non-citizens in California, they contribute to the census.
So it gives California a greater
population. And so it gives Florida more
congressional representation and more electoral
votes. And that is the major, um,
unbalancing effect that illegal immigration is having.
Yes. There are some of them in red States too, like Texas, but it's.
And some people have also migrated here
and have green cards and have work visas and so forth
that are also contributing to census information
because they live in these states.
Okay, but there are millions of illegal immigrants.
I'm telling you, there's also millions
of people that have migrated here illegally.
And so what are we talking about?
You're saying that our data is thrown off.
That's not what the president has been pursuing this entire election.
I'm saying the census is not based on legal voters.
It's based on people in the country.
Yes, but the election is based on illegal voters,
and there's no proof that anything
otherwise has happened in the history of our election.
So California and Illinois
and New York get more electoral votes because they have illegal
immigrants living in them.
I'm saying that is the problem for,
not so much that they're voting, but that they tip
the scale.
The problem for you may be that.
The problem for the president has very
specifically been that he thinks.
That elections are rigged.
That's a quote that he said.
That he thinks that our election system is flawed.
It's been problematic that he thinks people who are...
Well, it is flawed if there's...
Wait, he thinks that...
No, because they're not voting.
We're talking about the election.
They don't need to be voting because there's more power...
No, because you're moving the goalposts.
You're moving the goalposts.
The president said he wants to stop...
No, I'm correcting the right.
Illegal migrants.
Illegal migrants from voting.
I know, but the president's saying something different.
He runs the entire country.
And that's been my issue.
Is that a couple of days before the election,
you want now 20,000 different people
who took the time to mail in their ballot.
To be rescinded because you say so on top of the fact that we know
that immigration authorities have been knocking in certain states
from door to door, just questioning people about whether they have
the right to vote, which also could cause intimidation.
We know historically in our country, in our country, unfortunately,
that can make people really uneasy. Why don't
they just show up at the polls and show some ID?
There's also been threats in the past about.
Immigration authorities and other national
or federal authorities being at the polls,
which is illegal, and that happening for no reason.
And the president has denied it.
If there's no illegal immigrants voting
at the polls, Lindsay, then what is the issue?
That's what I said. If it's 28 of the millions
in California, then why would
ICE be at the polls? It makes no sense. Like for the numbers.
Because they suspect illegal immigrants are voting.
No, well, then that's why the law works.
And that's why we saw the DOJ is doing its job.
The law works.
So you arrest the 28 people prior to the voting
or right after the voting, rescind their votes
and do your job.
But you don't put fear in the entire voting population.
But we haven't caught thousands more.
Yeah, but the concern is that even
when you look at conservative think tanks that are
doing studies on this, you should see that even
though they try to find sufficient information
to prove that our elections may be fraudulent,
they failed because they put out the information
from this is not enough.
Well.
The answer to that could be because not enough
of them have been caught and apprehended and
prosecuted. They can only go based on the data they have.
They have the data from the people
who were successfully caught
or stopped. That doesn't apply to any other argument
that you make. No, it doesn't.
That's like, you want me to find the crime later and just say you
deserve to be a criminal and find the crime later?
They don't have proof of crime. The president does
not have a proof of a crime. So that's like me saying,
Robby needs to be in jail and I'll figure
out the crime later. People are always inferring that there's far more,
the prevalence of, for
For instance, sexual violence is.
Far beyond what actually gets prosecuted
or dealt with by the legal system,
that it's like one in three people
on American college campuses, which sounds-
Which is true, because people might say
these things, but they're not prosecuting-
That would have a higher rape rate than Somalia, but-
They're not prosecuting on these things.
Okay, that's what we're saying about the voting.
That's exactly what we're saying about the voting.
The president is actively trying to prosecute,
and the president is actually trying to-
Demolish our elections based on no proof.
No proof.
What are you saying?
Who is actively trying to rip apart these college campuses?
People are making awareness so that women
can protect themselves in college campuses.
I don't even know how this conversation got over here.
I'm just coming up with an example of something that I think
is far more prevalent than actual criminal prosecutions would suggest.
The precautions can be put in place.
A prominent here than in Somalia, which seems unlikely to me.
But I think that the president needs to point
to the problem and point to the exact proof
that he hasn't prosecuted the problem,
because that's how our law works.
Well, he's trying to do that.
And the Supreme Court has said no.
So he has to assemble more.
Everybody's wrong besides him.
The president also does not control.
He's not wrong about the millions of illegal immigrants who are here.
We have we have several ways before somebody actually.
Submits their ballot to protect from election fraud.
And also federal law that says people who are not
Well, I know, but his concern is that the state might
not have incentive to police this
because it's benefiting the people who run the state of California.
No, there's not some big conspiracy against President Trump.
He lost in 2020 and he's losing his argument
There's not even a small conspiracy against President Trump.
