An auto repair shop in Grays Lake failed to warn
their customers that they were driving a defective car.
Now, this same place is getting sued for wrongful death after
two people died last year of carbon monoxide poisoning.
Brett Boganski is live in Crystal Lake tonight.
And, Brett, the lawyer of the family
who's suing says all of this was preventable.
And that's what he told me earlier today.
And it was about one year ago at this subdivision in Crystal Lake
when police got a call about two people
who were pulled over to the side of the road.
It looked like they were sleeping inside the car.
But when police officers arrived, they found Yasamar.
Morales Sanchez and Kirby Graham dead inside the car.
So Graham was 32 years old when he died.
Sanchez was only 20 years old when they died.
And court documents said they died of carbon monoxide
poisoning from what they are claiming
was a car's defective exhaust system.
And this reportedly started in Grays Lake
at Amerimex Muffler's Brakes and Auto Repair
when Graham took his car in for an inspection
and to repair the car's exhaust system.
So this is a wrongful death lawsuit that is claiming
that the car shop did not repair the problem.
They knew about Graham's car having a defective exhaust system,
but they say in this lawsuit they did not tell him about it,
and then they allowed him to drive out of the shop.
The lawsuit also says the shop should have known there
were excessive levels of carbon monoxide
entering the car, which created what they're
calling unreasonably dangerous conditions.
It's true that the mechanics that
Technical expert at the defendant let these kids leave the store,
the shop with a vehicle that was
unreasonably dangerous, then that is negligence
and under the wrongful death act, they're responsible
to that mother.
And we did reach out to the car shop for comment,
especially about the allegations in this wrongful death lawsuit.
I'm still waiting to hear back.
But you just heard from the lawyer, Guy Glar,
who told me that he's also been having a hard time trying
to get a hold of the owner of this auto shop.
He was trying to find out if they have a lawyer,
what their insurance is like.
But he also told me that he wants to add the Graham family.
To this wrongful death lawsuit to
have them be on their side in this case.
Certainly we're going to continue
watching this in McHenry County for
this wrongful death lawsuit,
but we are live in Crystal Lake tonight.
