Over the weekend, a visiting judge denied a new trial motion for Carmelo Anthony.
Anthony was convicted of killing Austin Metcalf at a high school track meet
and is serving a 35-year sentence.
Fox 4's Stephen Dyle in our newsroom to break down what happens next.
Stephen.
After hearing that ruling over the weekend,
some thought that this motion for a new trial was the appeal,
and that's not the case.
The motion for a new trial is almost an automatic action by defense attorneys.
Last week, the trial judge was recused from the hearing for the motion for a new trial.
A visiting judge was then appointed,
and we heard testimony from lawyers on both sides of the case
revealing the gentleman's agreement to withhold damaging information
about Austin Metcalf, who was killed,
and Carmelo Anthony, who was convicted of murder.
Despite the new information, the judge, the visiting judge,
ruled the motion did not meet the grounds for a new trial.
The judge had to make that decision quickly to meet the state's deadline
before the end of the weekend.
Now, the real appeal process begins,
and the case will go through the Fifth Court of Appeals here in Dallas.
I spoke to well-known appeals attorney Gary Udishin,
who is not associated with this case.
Everything that happened in the motion for a new trial
will be part of the appeal.
There'll be a transcript of the hearing on the motion for a new trial
that'll be included with the transcripts of the trial itself,
and that will all go to the Court of Appeals.
I'm sure the defense lawyers on appeal
will be raising the same arguments to the Court of Appeals
that they raised in the motion for a new trial,
and obviously, those arguments are going to be a key issue on this appeal.
Udishin told me that the appeal filing will come together pretty quickly,
but we likely would not have a hearing on that appeal until sometime next year.
After the weekend ruling, the Collin County District Attorney
released a statement saying that every defendant has the right to appeal,
and he offered thoughts and prayers to the Metcalf family.
Anthony's legal team said that they will pursue
every available legal avenue for their client.
