Welcome to TMZ Live. So we have received a number
of text messages between Jane Doe in the Cornell
case and two of the defendants,
the two people with whom she started the evening in the frat
house with a three-way. And I will say some
of what you're going to see, you may have seen before,
but I don't think you've seen
the complete picture of how this is laid out.
We have that, and we're going to show it.
Right. So we're going to start on October 21st,
two days after the alleged sexual assault,
and she is texting with Jonathan Newell,
one of those two guys in the initial threesome.
So it starts with a text from Jane to Jonathan.
Jane says to Jonathan,
I'm not sure if you remember, but I did ketamine off your blank.
genitals at some point
and I honestly think that was one of the most insane slash
Jaw-dropping moments of the night Jonathan responds.
I'm just glad you're okay
I was kind of upset with all the stories going around earlier
But at the end of the day that's all they are and I have
no memory of that last part referring to the ketamine off
of his gender which is interesting because this is before any
of the allegations surfaced and she brings it up and
and is calling it insane
and he's saying i have no recollection of this thing right uh and then
she responds to him and says oh
not the stories i don't even think i don't even think i want to know
i know i'm socially a massive slut right now
and i like can't bear to hear it because i'm really not
so that's the exchange
with jonathan now we should just say we should we're gonna get on
We're going to give you more, but we should just say that what
her lawyer is saying is that it's not uncommon for rape victims,
he says, to not necessarily immediately process what actually happened
and that that takes place over time.
Yeah, well, we even heard that from her big
and other people that she lived with that when she came home,
she seemed like her sorority sisters
and like she couldn't even comprehend what was happening.
And they were both like, something happened to you.
But she just kept saying she was fine.
And remember, she's trying to reconcile things
that happened in the night over the course of time.
Initially, with Matthew Ingalls and Jonathan Newell,
she has said that she had a consensual threesome.
But subsequent to that, she has accused both of them of rape.
And both of them were eventually expelled over these allegations.
And that's true.
I think what we don't know is what happened.
we don't know whether she is a rape victim
or whether this was consensual and regrets after
the fact. And we just don't know.
So what we want to do is present the full picture. And by the way,
nobody can decide based even on what we're showing,
because this is going to take investigation,
cross-examination, all sorts of things.
So this isn't saying she was raped or not raped. We're
just laying out, here are the facts.
But I will say, it was, I believe, Jonathan that
also texted her, I'm so sorry what should
have happened. We were messed up and we couldn't
stop it because we were so messed up with having
more people come into the room.
It doesn't necessarily
mean rape. I mean, stopping
it could mean this got
way out of hand. But they
are saying something did
happen that they should have been able to control
but they couldn't. They're all
regretting it. Yes. And remember, one more thing
she has to reconcile this with what Jonathan texted
to a Snapchat group, which was
free pee in the alum room.
When she learns of that, she's now putting
Jonathan's, her interactions with Jonathan on text
with that. Jonathan is the
one who posted that message on the Snapchat.
That is relevant to
some of these other messages. We should just say Jonathan
got expelled. Right, and Jonathan did get expelled
because now we're going to
go to some texts that she, between Jane
and Matthew and
Jonathan, and perhaps it has to do with that Snapchat
message, he comes into this
because she and Matthew are trying to figure out
who's talking about what happened that night.
She says to him, bro, everyone knows I'm incredibly stressed out.
I will also say this is blanking, ruining my life temporarily.
My reputation is destroyed and I'm utterly ashamed.
And Matthew responds, stupid bitches like to yap.
And the fact they're doing it shows
that they're jealous of you for any number of reasons.
And Jane responds, you're right.
It'll get better.
You think everyone's just jealous of us?
But also, like, everyone needs to grow up
because sexuality and sex and blank is changing.
And stuff like this is going to become more common.
I'm also really open-minded, though.
So that was on October 23rd.
So what it sounds like is they are working on damage control.
um and that when you look at that last statement
the statement feels like she's saying everybody
relax this is not a big deal it'll blow over it's
not a big deal what happened was not a big deal
that she's saying hey this is just the way things go
and she seems to be trying to rationalize that
what happened is not a big deal
and people shouldn't be talking about it but now and we
believe this is a day later now so october 24th
or maybe it's late on october 23rd her tone changes
texting to matthew jane says jonathan definitely
told people i heard something today and i know
he told people uh matthew responds to her on october 25th i'll ask him
though it was definitely
one of the upperclassmen in the room
who told someone else and it spread and then he asks jane
who told you this if we can narrow down
the girl we can narrow down suspects i know it wasn't
jonathan trust me he would never
so he's defending his friend i suspect that i suspect that she now
knows about that snapchat message right yes it seems
and her tone changes but i don't think
she knew about all the snapchat
because she was still uh like yes and then when i think that she
found the whole screenshot of the snapchat that someone found
and she saw what matthew wrote in
the Snapchat, which is, you can come in
and whip it out, seriously.
And I think that that's when it turned everything.
And she was like, you were supposed to be my friend.
Because she also tells him in the text messages,
I have a UTI. You don't just say that to, like,
a random guy when you're, like, opening up about, like,
what happened. She truly thought that Matthew
was her friend and was, like, going to protect her
and, like, help her and not do this.
And I feel like it gets very cloudy.
Matthew, in responding to her, is still trying to,
at least saying, he's, look, whatever you need,
if you need medicine, I'll be there for you.
On November 7th,
Now, his tone changes because he's
clearly hearing things around campus.
And he texts to Jane.
Matthew says, my ex told me that I'm being labeled
as an assaulter in the public eye.
I was going to ask you, ask if you may have said something along
those lines to someone, but I know you wouldn't.
And she responds, people are changing the narrative
because like in any sexual scenario,
with one woman and many men, the woman was probably victim.
I know there are rumors I was gangbanged.
That's what James says to him.
So now they're both on edge about things that people are saying.
On November 8th, he texts her, are you free to call soon?
And then she responds, I think I'm done talking to you.
I know you lied.
He's confused and says, what, can you call?
And she says, no, never again.
Now, we should explain.
That is November 8th.
That is about a week after
this now infamous Halloween party where Matthew had invited
her to go to the Halloween party at that same fraternity.
And she was going to go, and then the fraternity president disinvited
her, and there was a radical shift at that point.
She said, you guys aren't my friends,
and she's very, very angry at the president.
Women always take the fall for these kind of things.
Right.
Yes.
So, look, those are the texts.
Now, you know, you could jump to various conclusions
and you could go one way or the other based on the text.
You could say, well, she's clearly saying she was down with it,
that the social mores should be relaxed.
People should relax. Who's the snitch?
And the other way you can look at it is over time,
she started processing this.
And maybe that Snapchat rang a bell for her, turned on the light bulb.
So you could look at it either way.
And we're not here to say to you, look at it one way or the other.
We're just laying it out.
And there are a lot of people in the media
that are saying definitively, this is what it means.
And I don't think you can say that.
I think you're right.
I think this evening wasn't a monolith.
It had consensual elements
and it had elements that were more questionable, certainly.
And I think as we see it evolve and her processing of it evolve,
people should see it all in context.
Because I think it's important to evaluate it that way.
Hi, I'm Janae from Mississippi.
My biggest concern with all of it is from her initial statement
to now what she's claiming, obviously, are vastly different.
And then, like you said,
the biggest switch up was after the uninvite to the Halloween party.
I never want to discredit a victim of any type of crime for sure.
But what I do want to know is why the guys
are being held to a different standard
for their intoxication levels versus her intoxication levels.
Well, I got to say, you really hit
on something that we haven't talked about.
But if this thing proceeds in criminal court,
what you just said is going to become a huge issue in terms of both.
Because you hear one of the guys saying,
I don't even remember what you're talking about.
So what you just hit on could become a central issue.
Coming up.
One of the stars of Pretty Little Liars left bloodied
on the streets of West Hollywood.
And there's video to show what happened to Keegan-Allen.
I was just robbed of my watch.
Be right back.
One of the stars of Pretty Little Liars left bloodied
on the streets of West Hollywood.
And there's video to show what happened to Keegan-Allen.
So, Keegan-Allen was outside a store
in West Hollywood called Laurel Supplies.
Right.
I've never been.
It's not the issue.
I know.
Actually, I heard a lot of people talking about it.
Well, no, no, the only reason it's important-
Is it a fancy grocery store?
It's a fancy grocery store, and that's important.
But he was leaving, he was in the parking lot outside
of Laurel Supplies when two men approached him,
and he says, in fact, the video supports this,
they pistol-whipped him to take his watch, to rob him of his watch.
A Rolex.
And this is right after the assault.
he's posting video but he
also had the wherewithal to go i would presume to the store and get
their surveillance which captured what happened i
was just uh i was just robbed of my watch
outside of Laurel Supply he called the police
but these two dudes hit me in the head
and pointed a gun at me with with a knife
And then took off.
I had masks on.
Took my watch, though.
Took my watch.
So, I mean, doing that, filming himself doing it right afterward
is just remarkable on so many levels to me that he did this.
And I'm listening to him and I'm going,
he should be, like, he probably has a concussion.
He should go to the hospital.
And you saw how that guy
who had the pistol really hit him hard a couple of times.
We know, and you hear him in the video,
that he says someone called for police.
We know police and paramedics came.
He refused to be transported to the hospital,
assuming they checked him out when they were there.
But he refused to be transported.
What's interesting is this is just such a nice part of West Hollywood.
It's a busy area.
There's a lot of people around.
To me, it's a little shocking that no one else got videoed.
but it's been happening.
It's not shocking.
This has been going on specifically with Rolexes
for years now,
and it's really been happening more in Beverly Hills.
We've seen video of people,
that exact thing happening outside of restaurants.
Remember?
What's the restaurant?
It's on Beverly Drive.
It's the outdoor Italian restaurant.
El Pisteo.
Yeah.
El Pisteo.
Right at El Pisteo.
They stole somebody's...
I have a friend who got basically the same thing that he got,
which was pistol-whipped.
They grabbed his Rolex, threw him to the ground.
Rolexes are a thing, and people are looking for them,
and they are targeting them, and they are doing things like that.
I mean, that's why I'm saying the store matters,
that you're looking for high-end places.
They're going to a high-end place, waiting for someone to come out,
and waiting to see if they've got something they want to rob.
Hey, my name is Maddie Fulton, and I am currently
a student at Georgia Southern in Statesboro.
And what happened to Keegan-Allen
was something very horrific and traumatizing.
And when I opened the comments this morning on a TikTok talking about
the situation, I was expecting comments like, I hope he's okay.
But instead, I saw comments talking about, oh, this is something
A did in regards to his character on Pretty Little Liars.
And I feel as if that is something
that is so deeply insensitive to say.
I think it's disgusting.
And I think, honestly, it just highlights
a much larger issue that our generation faces.
And I think that is just being completely desensitized
to other people's trauma and traumatic events.
Are people not able to separate?
Apparently not.
They're actors.
They're actors and they live real lives.
And people are really confusing the two.
Yep.
And that's just a phenomenon that we're seeing a lot nowadays.
And when you look in cases like traumatic cases,
especially in regards to what's going on right now with the Cornell 7,
We have people in comment sections and making TikToks and YouTube
videos and Instagram posts about Shonda Rhimes scandal characters
allegedly saying that they could fix and solve the situation.
And ultimately, I just feel like
that is just very disheartening and disgusting.
It's truly disgusting because in my eyes, I see that if you're somebody
sitting there calling for like jokes about something so serious, you're
in the same category as the people calling for her name to be exposed.
jane doe and i think that it honestly it just highlights
a much larger issue in society of
us as a generation being so desensitized
and just choosing to move along with issues
and with keegan allen mentioning
that west hollywood is quote getting so much worse
i don't think that i agree in the same way
that he means it i think i'm mainly saying that
the reason it's getting so much worse is due
to the neglect that we have and the way that we just
brush past these events and stuff like that
because, again, they become sort of fantastic.
I gotta say, I don't think it's getting so much worse.
I think it's been this way for a while.
Okay, name that tune.
Ba-dum-bum, bum-bum-bum, bum-bum.
What, you gotta plug your old show?
Yes, man, we all watch People's Court.
Well, it's too bad to be...
Wow, do you miss it?
It's too bad, well, I miss it today
because it's too bad we're not taping
because if we did, we could get Taylor Swift
and Travis Kelsey as defendants in the show.
Oh, I would love to see that.
They are having a huge neighborhood dispute
in the most unlikely of places.
In Cleveland, Ohio,
where Travis had purchased a beautiful lakefront mansion.
And as part of that purchase, wants to put up a fence.
Not shocking.
Obviously, they want privacy, have security concerns.
An aluminum fence.
An aluminum fence.
A black aluminum fence.
with a sharp top.
Sharp, pointy, you know, barbs on it.
So that is not sitting well with the neighbors.
And there was a whole,
there was a community meeting to discuss this.
It got pretty heated.
Folks just think that these changes
that they want to make there,
it's not just about it's ugly or it's not right.
They're concerned about wildlife.
They're concerned about-
We should say, the wildlife, they're separate things.
The wildlife, they have deer there
And they're afraid the deer will try to jump the fence.
They'll get impaled.
And they're also concerned about sewage.
So there's a sewage line that's near the fence they want.
And what they're afraid of is that Taylor
and Travis were going to put trees up for privacy.
And they were afraid that the roots
of the trees could compromise the sewage line.
So now you've got all these neighbors who are ordinary folks saying,
these fancy schmancy celebrities are screwing up our neighborhood.
Yeah. And so in these documents we obtained because this meeting
that you guys are referring to, this happened about a month ago.
It's been like an ongoing issue. And from the meeting,
one of the women that is a neighbor of Taylor and Travis, she said,
like, look, these are just, you know, these Hollywood people coming
in and they might not even live here for that long.
So they're basically saying, like, this is their home.
They're going to have to drive by this house,
see this tall gate fence thing.
And, you know, they just don't want that gate there at all
because of that sewage line you mentioned.
They suggested to put that wall back
so that it didn't interfere with that sewage line.
But the residents are just saying, like, yeah,
but now you guys want to put these trees.
The roots could somehow affect that sewage line and cause a disaster.
Look, there are areas of the city where
these houses are out in the open.
It sounds like this is a community
where you're not hiding behind walls.
And I'm not saying that's a bad thing.
But the reality is they do need that privacy because of who they are.
And I'm guessing the neighbors are just thinking,
this is kind of messing up the vibe of the community.
And I really think that's at the base of this whole thing.
Yeah, I'm sure that's part of it.
So the fence has been approved.
So the fence is going up.
Um, I guess there, if there is still something to debate,
it's where the fence is going to go.
Where the fence is going to go, can they have the trees there,
and also those barbed tops that you guys mentioned.
The barbs are going to be there.
Hi, my name is David Zibra, and I'm from Prague, Czech Republic.
I actually think that the neighbors just want something to complain
about, like, just classic arguments, and I guess it doesn't make sense.
it's not a big deal and I guess and I understand that Taylor
and Travis need some privacy because
they are like literally everywhere all the time
so I get it and I guess they really need some break
from like public eye where are you from Czech Republic I'm
from wow Prague Czech Republic yeah
huh yeah but maybe I'm biased because I'm Swiftie
so let's see god even in the Czech Republic we
just low-key Swiftie low-key Swiftie coming up seems there's
a disagreement growing in the Trump
administration secretary of defense Pete Hegseth came out
and said that the Fort Hood shooter not
only are they going to have the execution in December
but it will be streamed JD Vance is
saying not so fast be right back TMZ's got every
freaking thing big celebs big stories big events
Donald Rollins took TMZ DC on a city tour.
You know what the irony of this is?
A black man takes a white person to the White House.
It's TMZ.
Seems there's a disagreement growing in the Trump administration.
I'm sure I've heard that the Secretary of Defense, Pete Hegseth,
came out and said that the Fort Hood shooter who was sentenced,
got a death sentence.
By firing squad.
By firing squad, Hegseth said that not only
are they going to have the execution in December,
but it will be streamed, that they're going
to live stream this firing squad killing the shooter.
I'm going to shut up for now.
J.D. Vance is saying not so fast.
You have talked a lot about your Christian faith in recent days.
reason. How does that mesh with the Pentagon's announcement
that they wish to live stream the
firing squad execution of the Fort Hood shooter?
Well, first of all, I've seen those announcements.
I don't know that that's actually going to happen.
Let's sort of see what, I think it's
going to happen in December when he's executed.
But what I try to remind people is, look, this
is a guy who committed, in my view,
the worst terrorist attack on American soil outside of 9-11.
The people that he was meant to treat,
the army soldiers that he was meant to treat,
for mental illness and other problems,
he took them at their most vulnerable and gunned down
these people where they live.
So whatever the controversy is about the method of the execution,
I hope that people don't forget that this is a guy
who brutally murdered a lot of innocent people.
Now that said, I mean, look, if it's ultimately live streamed,
I'm not going to be watching it.
I got to say something. I want to say something.
This G.I. Joe is our defense secretary.
this is abhorrent that he is doing this that we have
so much violence in this country and the idea
that you would allow children and others
because they are going to watch online to watch somebody
be shot to death to watch their head explode to what
and and by the way i'm not talking about the
death penalty the death penalty was um it was sanctioned by a judge
and you do what you do
But the idea of saying, and we're going
to live stream it, this machismo.
Don't watch, man.
That's disgusting.
I don't put it online.
You question people and laughing at your service
and to call him that G.I. Joe, whatever you did.
He's a G.I. Joe.
You should be ashamed of yourself for saying that.
He's a G.I. Joe macho crazy guy.
That is so disrespectful to his service.
And the fact that you can muster up
a single you-know-what to care about.
No, no, no.
What we're talking about.
That's outrage.
Mike, I don't.
First of all.
He is acting as a defense.
Don't watch it then, Harvey.
Don't watch it.
Mike, you're doing exactly what kids.
Are you kidding me?
Do you know how many?
There's pornographic movies out there.
Kids, don't watch it, Harvey.
This is real.
You guys are making this about.
You've got to be kidding me.
This is not about.
Oh, my God.
You've gone too far now.
This is not about sympathy for the convicted shooter.
No, I'm not going to watch it.
When they announced that he got
the death penalty, nobody said anything.
There wasn't outrage over him getting the death penalty.
The outrage, and you heard J.D. Vance try to shift around the question.
The question was about live streaming it.
And he said, no one should have sympathy for this guy.
That's not what we're talking about.
We're talking about, we're talking about,
we are talking about, no, I'm talking about
Jamie Vance.
I'm talking about, I'm saying that to make this,
it's not about sympathy for the killer.
It's about what are we as a country,
if we are now going to start live streaming execution.
I'm all for that.
If you go to an army base and you're going to gun down 13 people.
Why didn't we live stream Chris on Mike?
Get it into my veins.
if we're that country i love it i want
to do that you die i want to ask you one question
why didn't we last see krista do you think video i would
be down do you think video games so i don't
care about that do you think video games have
in any way contributed to gun violence yes if video
games contribute to gun violence what do you think is going to happen
when people see the real well
maybe it has a chilling effect on people
who try to enact terrorism that's going to happen maybe it's
never happened before every time people see it
in the movies they see it in video games it goes up
you think the real thing it's going to go down i i
do i do hey guys how you doing my name is lucas
i'm from upstate new york in the adirondacks
um and you know listening in i think the guy 100
deserves it um i think you know if you are going
to gun down these people and then you're going to
turn around and add more salt to the wound
and say that you know you're defending taliban leaders
and try to justify it.
I think you absolutely should be gunned down, executed.
I think people should be able to come and see it.
I agree, though.
I don't think it should be live-streamed
because I think that's being used as a way
for people at a different angle to make money
and to profit off of it and then use the whole,
well, he deserves it anyway excuse to live-stream it
because, again, there are kids that can watch it.
If people want to go and see it in public,
then that's up to the parents if they're going to bring their kids.
You know, that's on the parent.
Well, they don't do it that way,
But they would allow victims' families to show up,
which they customarily do.
I just know decades ago
when we started seeing those ISIS videos of beheadings, right?
And what we thought, oh, those people are absolute monsters.
And they are.
And they were.
So are we okay with becoming monsters ourselves?
That's what I'm talking about,
is the live streaming of this just seems like a step too far.
Right.
Coming up, we have received a plethora of text messages,
information from the Cornell disciplinary panel,
and we have identified what could be the core issue
in deciding whether criminal charges
are going to be brought in this Cornell case.
Be right back.
We have received a plethora
of text messages,
information from the Cornell disciplinary panel,
and i think we have identified what could
be the core issue in deciding whether criminal charges
are going to be brought in this Cornell case
and it has to do with one word and the word is consent
now charles and i that may seem obvious
but there's a reason that we're talking about that
because it seems that different people involved
in this case are defining that word differently
Absolutely. Now, we broke a story today that Jonathan Newell,
one of the defendants in the civil case, was expelled from Cornell
because he engaged in sex with Jane Doe without her consent.
But we have looked, we have spoken with somebody
who has reviewed the disciplinary panel's decision.
And what it says is that he did not get affirmative consent.
That means essentially a yes, that there is a discussion.
That at no point she never said yes.
That she never said yes or conveyed yes in some clear fashion.
In New York State?
No, no, no.
Oh.
At Cornell University, in Title IX, the way they define consent
is that you actually have to get that kind of affirmative approval.
That silence is not enough.
That you need that kind of affirmative approval.
and as a result of that they said Jonathan Newell did
not get her consent at some point
when they were engaged in sex right
so that is the Title IX and we know by the way there
were multiple times that they were that during
that incident that they engaged in sex that's
right so now the question okay
that's what Title IX says that's what Cornell said
now how does that relate to a criminal prosecution
because this is what this all started with where
the DA decided not to pursue it right i think it gets back
to this word consent but not the Title
IX version of consent the New York State law version
is that's what the DA would have to
would process would have to charge someone under
is under New York state law why didn't he charge
any of the men involved with rape.
In New York state, it is not enough to say there's a lack
of consent because of silence.
And that is the difference between the Cornell disciplinary
hearing and a New York criminal case.
So because to the general public, you will hear that Cornell
expelled Jonathan Newell because he had sex with her without consent.
And you may go, well, that's
rape. And if Cornell found that it was rape,
why didn't the DA charge him with rape?
That's right. But the difference is that if she was silent
and never said yes or no,
that could be a violation of the Cornell rule under Title IX.
But it is not in itself a violation
of New York state criminal law
because New York law requires that there be some clear expression
the of no no the word no right
and in order for that to happen so Cornell never found that
they never or the DA never found that well Cornell never said
but can you find lack of consent that
was given to him to have sex
with her and that's all like you really need to press the charges you
just need lack to prove consent.
And I do want to point out that part of her allegation is that
when Matthew Ingalls stopped having sex
with her during the initial consensual threesome.
Matthew Ingalls is another person. Matthew Ingalls
was the initial threesome with Jonathan
Newell. When he tapped out, he took a nap at some point.
But she says, hold on, hold on. She says
that Jonathan Newell then started groping at her vagina
and she indicated by pushing his hand away
a lack of consent to that contact.
She says another man then entered the room and the two
of them, Jonathan Newell and the other man,
Helio Lopez, then had non-consensual sex with her.
That's her allegation.
I can say, because I've looked at New York law, that would be forcible
and forcible is enough to prove rape in New York state.
So if those allegations prove to be true,
if they are provable,
then you could say that it fits the New York criminal law because it's
forcible but in terms of consent that doesn't
that what what the Cornell University found
you know we got a um a text from Jane Doe's lawyer
and Jane Doe's lawyer said that they found there
was no consent what they found actually was there
was no affirmative consent um no expression of no
and he went on to say that is the definition
of rape it's not the definition that in itself
is not the definition of rape
in New York State.
Yes.
If there's proof
that it's forcible,
then it is.
But Jonathan said
the entire time
that he didn't get consent,
that he just thought
that Matthew got it
for the very first time
and he was like,
since Matthew got it,
like, I didn't get it,
I just thought, like,
I got it through a third party.
He thought it was maybe
a carryover of the initial
encounter which was consensual.
He said that the entire time
for the initial encounter.
Yeah.
I mean, look.
It's very, very complicated.
It is.
All we're saying is,
you know,
now that we've gotten
all these texts
and we've seen the stuff
from the disciplinary committee,
like that word is going to be critical
in a DA or a grand jury's decision on whether to prosecute
these guys. And I'm not saying which way they're going to go
because I don't know. And she made an
allegation in her lawsuit.
And if that allegation is true, it would seem to be enough to prove
forcible. I will say this when they go before a grand jury,
as we've said, that it is very easy
to get an indictment for a prosecutor
because except the prosecutor they're looking for now
may have some issues that's right yes well
my whole thing is don't you think it's weird the DA
that they got expelled the university found
that there was like stuff that was wrong that there
was no consent so they expelled them don't you
think it's that the DA is like a little bit
weird that they didn't investigate a little bit these are different
yeah that is true it seems a bit cursory
and that's why we're reopening here i guess what
i'm saying is if you go before a grand jury
and you present the fact that or you present
the allegation that
Jane pushed his hand
away multiple times.
That is, before a grand jury,
that sounds like a no.
It sounds like an expression of a no.
Through a physical gesture.
Which would be enough.
Enough to indict.
Also, if a jury
believes that, that may be enough to convict.
I'm not getting to the conviction
part, I'm just getting to whether or not
the jury will let her on.
Let's now back up from
the grand jury about who is going to present
the case to the grand jury, because Letitia James,
the New York attorney general
who has been appointed special prosecutor by the governor
of New York, she's gotten some serious heat by lawyers in this case.
Yes, lawyers. Now a second
lawyer has come forward representing Winston Lee.
Another one of the accused frat brothers is Tenny
Garagos, and she has filed documents
with some serious concerns saying that Letitia James should
be removed from this case
and and the reason is she's of the statements she's made where she said
that we stand with jane doe called it horrific what she went through
was horrific she's very
much citing in these statements citing with jane doe
and these statements were made before she was
appointed special prosecutor subsequent
to being appointed she said all the right things about
conducting an honest and unbiased investigation
but it's hard to unring that bell when you've
made comments on Twitter to the kind of already have
that so so Tenny Gargas is saying number
one, poll grand jurors to see if they heard
this because this could pollute the grand jury pool.
Number two, she is taking a shot at Kathy Hochul saying
that this was political because her
opponent, and this election is now looming,
has been saying she's soft on crime. And so she was
doing this to gain some political chips,
which we don't know what the judge is going to say,
whether the judge actually issues an order
either affirming that it's okay
for Letitia James to serve or not.
Yeah.
We already know that there is a hearing scheduled
for, what, October 27th, 29th,
where in Albany,
because there was another attorney
that had, Andrew Wiltenberg,
had filed something very similar.
On October 29th, he's going to get to present his case
why Letitia James should be removed.
I will say it's hard to tell an executive
have had to conduct an investigation,
although the circumstances here are very clear because
the comments were on Twitter.
It does look like she has prejudged this issue. It would
be cleaner, certainly, to have another special prosecutor.
They both went out of their way
to say it.
Why didn't she do that?
It's an unforced error
because they both went out of their way to say it.
Why didn't they just do it?
We don't want to stop the investigation.
We just want a new special prosecutor who's unbiased.
They could have picked 100 different people.
That hasn't said anything about it.
That hasn't said anything about it.
Why her?
Hi, my name is Beth. I'm from Charlotte, North Carolina.
I came on to talk about Jane Doe's text messages.
And I think when I read your article,
I see a woman trying to make sense of what happened to her.
And there is no sense to be made of a sexual assault.
I was raped a week before my senior prom.
And I still went to prom with the boy who raped me
because I didn't see another way out.
I was trying to bargain with what happened to me.
and going to prom with him wasn't about
that he had consent for what he had done to me after abuse
there is shock and numbness trauma
and jane was probably feeling all of those things during those
text messages in the end she realizes
who matthew is and what they have done and she says i'm done
talking to you i know you lied she is brave
and i think so many women stand with her because we've
been her. We are Jane Doe. Thanks.

We're going to have to invest in some big-ass buses.
Do we need bigger buses?
We'll get you a Greyhound.
Okay.
Sounds good.
Can we cut the roof off of that?
Okay, here's the big thing.
Uh-huh.
Are you going to jump on the bull at the Saddle Ranch?
Absolutely.
Listen, I live in Nashville.
Oh, okay.
Well, there you go.
That's my thing.
I'm always on the damn bull.
No, that's true.
Thank you very much.
You're in Nashville, really?
Yeah.
Uh-huh.
I used to live here, but I've been in Nashville five years now.
So, yeah, I'm always down for a bull.
Okay.
I hate to ask this.
Which is better?
Ooh.
You can be our Nashville.
Be honest.
I'm a Southern boy.
I'm from Louisiana, so I have to say Nashville.
So you grew up in Louisiana, you came out to L.A.,
and then you moved back to Nashville.
Exactly.
All right.
I love it.
But I do miss L.A.
L.A. is a good time.
It's a party, and we're definitely going to party tonight.
You're going to go through Hollywood, West Hollywood.
You just barely hit Beverly Hills and then back to Los Angeles.
Period.
So you're going to see the best part of L.A.
Oh, hell yeah.
I'm ready to cut up.
And there'll be some shots along the way, also.
Oh, yeah, no, no, a lot.
Several, several.
Three shots along the way for people.
Three shots. It is a great party if you're ever in L.A.
You got to check it out.
Have a great time tonight, Landon.
Looking forward, I can't wait to see the video.
Really appreciate you coming by.
Of course, nice to meet y'all.
Nice to meet you.
Thanks, man.
Y'all.
Coming up.
So Ben Affleck is letting us in on what he does in his free time.
He plays video games, right?
Which is not uncommon.
This part, I would hope, is uncommon.
This is what he said on New Heights about running
into younger players of these video games.
I don't suck, I'm a grown man.
Be right back.
So Ben Affleck is letting us
in on what he does in his free time.
In between making movies, commercials, coming up with ideas for Dunkin.
Marrying.
He's getting married, getting divorced.
He plays video games, right?
Which is not uncommon.
And this part, I would hope, is uncommon.
This is what he said on New Heights about running
into younger players of these video games.
I play, like, first-person shooter games.
So I think I'm good.
You know, I'm even trying to f*** around and get on.
And then, like, 12-year-olds just f*** you up.
You know what I mean?
I try to come out, and I'm like, here I come.
Bah, bah, bah, bah.
Like, I get killed right away.
And then they taunt you.
Like, you suck.
F*** you.
I end up getting in an argument.
F*** you.
I don't suck.
I'm a grown man.
I think I've seen some videos online,
like YouTube videos where adults are like,
is this really happening?
It's weird that I didn't take him as a gamer,
but it is very relatable.
I don't play video games for that exact reason
because these kids are so good
and they're so annoying on the mic
and it just ends up pissing you off.
So that's a very relatable.
Is it because of his kids?
No, he's saying he's playing first-person shooter games.
I mean, he might have started playing with his kids,
and that he enjoyed them.
Because he's so into it.
Oh, he's definitely into it.
Hold on.
There are adults who play video games, Harv.
It doesn't have to be because of his kids.
But he reverts to 14 when he talks about it.
Well, have you heard these kids on the mic?
They're ruthless.
I've seen some of the videos online,
and I just go like, I could not.
No way.
Hey, guys.
It is Jamie in Chicago,
and I just have to say,
now that I know that Ben Affleck is gaming,
maybe I'll learn to game so he can yell at me,
because that sounds kind of hot.
Oh.
You know, oh, turn the video gaming into a dating...
So maybe this is his play. I get it.
No, it's not his play.
I don't know. Maybe it's his play.
Coming up...
Mariah Carey's doing a little vacationing over in Italy,
but she's doing something that you don't normally see people do.
She went to go see the Da Vinci's Last Supper.
Why is that not normal to see?
Well, I don't think people, like, sort of strike a pose in front of it.
Be right back.
Well, Mariah Carey's doing
a little vacationing over in Italy.
Milan.
In Milan. Milano.
Come on, man. You gotta work on your Italian.
But she's doing something that you don't normally see people do.
She went to go see the Da Vinci's Last Supper.
Why is that not normal to see?
Well, I don't think people, like, sort of strike a pose in front of it.
Oh, I think you're so wrong.
You think people do?
Oh, I think half the people do.
Really?
Literally half the people do.
I mean, as Mariah, you know,
striking a pose goes, it's not that dramatic.
You know what?
It is true.
No, go back to her for a second.
It's the last supper.
Hold on.
It's the last supper meets the Mona Lisa.
She's striking that pose.
That's not the Mona Lisa.
Look, go back to Mariah.
That is not Mona Lisa.
Look at her face.
It is not.
She's striking the pose.
But I will say this about the look on her face.
And anytime you're in front of something like
The Last Supper, you have to decide.
Are you going to smile?
How do you pose in front of The Last Supper?
She's doing the Mona Lisa.
Anything you do just seems...
She's doing the Mona Lisa.
You're not seeing it.
That's not the Mona Lisa.
It is so.
It's not.
It's not.
Have you not seen the Mona Lisa?
I've seen the Mona Lisa and I've seen The Last Supper.
I've seen Mariah Carey.
I have not.
Have a good weekend.
