AI GeneratedDale Smith Jr. has been arrested in connection with the 2011 murder of his ex-fiancée, Michelle Parker. Police apprehended him just days before he was scheduled to fly to Colombia. While prosecutors cite the travel plans and a visit from the suspect's son as key developments, the defense argues the trip was routine and that the state lacks concrete evidence.
New here at five tonight.
We're learning police arrested the man accused of murdering Michelle
Parker just a few days before he was sent to travel out of the country.
Welcome in at five. I'm Jack Royer and I'm Luann Sorrell.
Dale Smith Jr. has been locked up in the Orange County Jail
for the past week. Fox 35's Manny Martinez is live there tonight.
So many prosecutors also say the suspect's son went to police
to ask if his father was still a suspect in this case.
And Luann, prosecutors say that visit was
earlier this month, about two weeks before Dale Smith Jr. was arrested.
We're learning all of this
from a court filing today,
where prosecutors are asking the judge to keep the affidavit,
the paperwork that explains how police zeroed in on Dale Smith Jr.,
sealed out of the public
until next Monday. Prosecutors say October 2nd,
Dale Smith Jr.'s son, one of the twins he shared
with a woman he's accused of killing,
went to police to ask about the status of the case.
like do they have leads on the location of his mother's body
and whether his father was still
a suspect. The state attorney's office says Tuesday of last week,
cops found out Smith Jr.
was planning to fly to Colombia, the country in South America.
The flight out was scheduled for
the 16th with what prosecutors say
was an easily cancelable return trip on the 19th.
Police arrested Smith last Wednesday on the 14th.
Prosecutors say police waited to do two
out-of-state interviews
with witnesses until after they arrested Smith because they didn't
want him to flee. His attorney says there's nothing wrong
with a weekend trip abroad
because he says it's a trip
his client has made 18 times in the last six years.
I've got his passport here with stamps.
He goes there usually on a Friday,
comes back on a Sunday. He's romantically involved
with somebody in Columbia. So
he didn't know this arrest was coming.
He didn't know the investigation was still hot.
Smith is charged in the murder of his ex-fiancée, Michelle Parker.
Police say he was the last person to see
her that night in November of 2011
when she was dropping off the twins at his house.
It was the same day the couple appeared
on a pre-taped episode of the People's Court,
arguing over a $5,000 engagement ring.
Smith's attorney, along with several local news outlets,
are pushing for the public release of the full investigative paperwork.
They arrested him. They do a press conference.
They have all these authorities talking about all this new evidence,
but they won't show it. They won't show it to the media.
They won't show it to the public.
For 15 years, they've been saying my client is the sole suspect,
but they haven't shown
one shred of evidence.
His attorney, very obviously passionate about this. Prosecutors
say they're going to let the court filings do the talking for now.
Coming up next hour at six,
how Smith's attorney says police turned what
was supposed to be his son asking them questions for
an update on the case into an interrogation.
We're live in Orange County. Manny Martinez, Fox 35 News.
