It was a terrifying scene in September.
If you remember, a SUV driving in the wrong direction,
slamming into a metro bus
and killing two people and injuring six others.
That driver is in custody and it was in court today.
Let's get to Gigi Graciette live
in San Fernando with more on what happened. Gigi.
Well, this actually may sound familiar to you,
but Bailey Lynn Rios is not here yet.
We understand she's being brought by jailhouse personnel,
by deputies in a special transport van
because she is no wheelchair.
Now, the last two times we saw her, she was on a gurney arriving
once by ambulance. Take a look,
this time it is by wheelchair and this is a result of the injuries
She too suffered in that horrific crash.
Now, the first time she arrived on that gurney,
a judge ruled that she was in no medical
condition to be charged.
Several postponements later,
she was eventually charged with those two counts of murder and
more for driving and crashing into a metro bus in Chatsworth,
killing two passengers
and injuring five others.
Now, back then in September,
she was represented by a public defender and the 36-year-old
did enter a plea of not guilty.
Today's hearing.
Is to set a date for another hearing, the prelim,
where prosecutors will lay out their case against Rios.
They're going to charge that on September 15th,
she was driving under the influence of drugs while speeding,
running a red light, and then crashing into the middle of that bus,
killing 46-year-old Daniel Castillo and 31-year-old Gage Wideup.
At the prelim, a judge will then decide whether there's probable cause,
enough evidence, to hold the case over to trial.
Now, Rios has remained behind bars since the accident,
her bail has been set at $4.1 million.
And today we may see her public defender,
whom I already saw on the court if he's still
representing her, put in a request for a lower bail amount.
But again, she's not here yet,
she's expected to arrive by special transport.
And we're told she is arriving in a wheelchair due
to the injuries she suffered in that crash.
Of course, we'll have the latest when she does.
If and when she does arrive,
we'll be in court and we'll bring you the latest coming up.
For now, I'm Gigi Gracia, live in San Fernando.
I'll send it back to you.
All right, Gigi.
Keep us updated.
Thank you so much.
