12-year-old boy lucky to be alive after he
was struck by a speeding car.
And shockingly, the initial police report blamed the child.
Fox 5's Kelly Kennedy has more on the incident
and why neighbors say the crash could have been prevented.
Three boys were trying to cross
the street right here at this intersection behind me
when an SUV came speeding down 75th Avenue here in Glendale,
hitting two of those boys.
And we've learned this is the second time this year that someone
was seriously hurt right here at this intersection.
It started off like any normal October afternoon.
Surveillance video shows three boys headed home
from school in Glendale, Queens,
trying to cross 75th Avenue at 60th Lane,
when suddenly an SUV comes barreling through the intersection.
Fox 5 froze the video before the impact because of the graphic nature.
But two boys are struck, including 12-year-old Everett Sovereign,
who was thrown into the air.
He suffered a broken pelvis,
fractures around his eye socket, and a concussion.
He's recovering and it's going
to take him many months to be able to walk again.
But here's where the story takes another turn.
The initial police report says the driver had a green light
and blamed the crash on pedestrian error.
They did amend the report, but it still cites pedestrian error.
Council member Phil Wong says his office,
not the NYPD, tracked down this surveillance video,
which shows that the driver was clearly speeding.
No one interviewed the kids.
Nobody interviewed the neighbors who saw the accident.
Fox 5 found the SUV's license plate had been linked to 125 violations,
including 33 speeding and four red light camera tickets.
But the vehicle is registered to someone else,
so it's unclear whether the driver behind
the wheel was responsible for those violations.
We also learned this was not the first time someone's
been hit at this intersection.
Another man was hit at the same intersection back in March.
Why hasn't more been done to make this intersection safe?
I wish I had the answer to that.
That man was Michael Benham.
He was hit by a speeding car while taking out his child's car seat
at the very same intersection this past March.
His wife, Megan Taddeo Benham, was seven months pregnant at the time.
He has his third surgery this Friday,
which is going to be about six weeks,
where he's going to be completely off
at his feet again, can't do anything.
He can't carry our son around in the apartment still.
And then two weeks ago, the victim was her friend's son.
She even heard the sirens.
For me, it was really frustrating
and really hard to swallow because two weeks prior,
I think it was two weeks,
I got a letter from the DOT, just a form letter,
denying my request for installing a traffic signal
at the previous block that would slow
drivers down. Councilman Wong along with Tadeo Benham
and others in the community are now pushing
for more traffic enforcement,
a crossing guard and other safety improvements along the stretch.
Everett's mom tells me her son is now home from the hospital
but he still has a long road to
recovery ahead of him.
The NYPD says their collision investigation squad is investigating
and so far no arrests have been made.
Reporting in Glendale, I'm Kelly Kennedy, Fox 5 News.
